Terms of Service

Please read these Terms of Service carefully before using Getly. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using Getly.store, you agree to these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use the platform.

We may update these terms at any time. Changes will be posted on this page, and continued use of the platform after modifications constitutes acceptance. For material changes, we will notify you at support@getly.store or via in-app notification.

These terms constitute a legally binding agreement between you and Getly.store.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Getly. By using the platform, you represent and warrant that you meet this requirement.

If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these terms.

3. Accounts

3.1 Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Seller Accounts

Sellers must create a store profile and connect a payment method (Stripe Connect or a cryptocurrency wallet) to receive payouts. Sellers are responsible for all products listed under their store.

By becoming a seller, you agree to comply with all applicable tax laws and are solely responsible for reporting and remitting any taxes owed on your earnings.

3.3 Buyer Accounts

Buyers may purchase digital products, leave reviews, and participate in platform features. All purchases are final unless the seller's refund policy or platform policy provides otherwise.

3.4 Account Security

You must immediately notify us of any unauthorized use of your account. Getly is not liable for any loss resulting from unauthorized access to your account.

4. Products & Content

4.1 Listing Rules

Sellers must own or have the legal right to sell all products listed on the platform. Product descriptions must be accurate, complete, and not misleading. Listings must include appropriate categories and tags.

4.2 Pricing

Sellers set their own prices. Products may be listed as fixed-price, pay-what-you-want (with a minimum), or free. Prices are displayed in USD and may be shown in other currencies for convenience. All transactions are processed in USD.

4.3 Digital Delivery

Upon purchase, buyers receive download access to the product files. Download links are valid for 24 hours and limited to 5 downloads per purchase. Sellers are responsible for ensuring files are functional and as described.

  • Maximum file size: 500 MB per file
  • Supported formats: All common digital formats
  • Versioning: Sellers may update product files; buyers receive the latest version
  • License tiers: Products may offer multiple license options (personal, commercial, extended)

Getly stores files on secure cloud infrastructure (Cloudflare R2) and generates signed URLs for each download.

5. Prohibited Items

The following types of content are strictly prohibited on Getly:

  • Copyrighted material without proper authorization or license
  • Malware, viruses, trojans, or any form of harmful code
  • Fraudulent, misleading, or deceptive product listings
  • Content that is illegal in any applicable jurisdiction
  • Adult or explicit content without proper labeling
  • Products that infringe on trademarks or trade secrets

Getly reserves the right to remove any product and suspend accounts that violate these restrictions without prior notice.

6. Intellectual Property

Sellers retain full ownership of their intellectual property. By listing a product, sellers grant Getly a non-exclusive, worldwide license to display, promote, and distribute the product on the platform and in marketing materials.

Buyers receive a license to use purchased products according to the license tier selected at purchase. This license does not transfer ownership of the intellectual property.

Getly respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). To file a takedown notice, visit our DMCA Policy page.

7. Purchases & Payments

All payments are processed securely through Stripe (credit/debit cards) or NOWPayments (USDT/USDC stablecoins). Getly does not store your payment card details.

  • Platform commission: 20% of each sale
  • Seller payout: 80% of each sale
  • Payouts processed on the 1st and 15th of each month via Stripe Connect or stablecoins

Refunds are handled according to each seller's refund policy. Sellers set their own refund window (default 30 days). Getly may issue refunds in cases of fraud, policy violations, or unresolved disputes.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal data.

9. Termination, Suspension and Account Blocking

You may close your account at any time by contacting support. Where no investigation under the grounds listed below is open against you, pending payouts are processed on the regular schedule. Where an investigation is open, paragraph 9.A applies.

Getly Store may, at its discretion, restrict, suspend, or terminate any account for violation of our Platform Rules (https://getly.store/rules), these Terms of Service, or applicable law. The specific facts are set out in an individual notice to the user. Getly Store is the final arbiter of the application of its own rules.

  1. Fraud: creation of false orders or payments, manipulation of the payment system, impersonation of another user, or other conduct aimed at obtaining a financial benefit by deceiving the platform, buyers, or sellers, as confirmed by internal review.
  2. Repeated payment chargebacks exceeding the thresholds set by the payment systems (typically 1% of transactions or such other thresholds as may be set by the rules of Visa/Mastercard, Stripe, or the applicable processor).
  3. A material violation of these Terms of Service not covered by any other, more specific ground in this Section, provided that prior warning has been given and a reasonable period to remedy has been allowed, except where the case is classified as urgent under paragraph 9.3.
  4. Hosting prohibited content: illegal material, NSFW/18+ content, malware, or other items expressly forbidden by Section 5 of the Terms.
  5. Intellectual-property infringement: repeated substantiated copyright complaints (DMCA or equivalent procedures) for which no counter-notification has been filed, or for which the counter-notification window under applicable law has elapsed without resolution in the user's favour. See Section 6 and the DMCA Policy.
  6. Review and rating manipulation: paid or incentivised reviews, fake reviews, coordinated activity between linked accounts, or other conduct distorting the rating and ranking system, as evidenced by platform logs.
  7. Spam, bulk unsolicited promotional messages, or abuse of the private-messaging system.
  8. Creating or operating multiple accounts to evade restrictions, sanctions, or platform fees.
  9. AML/KYC triggers: inability to verify the account holder's identity, beneficial owner, or source of funds in accordance with applicable anti-money-laundering and counter-terrorism-financing legislation.
  10. Submission of false, forged, or third-party payout information.
  11. Multiple substantiated buyer complaints: three or more confirmed complaints within 90 days (unfulfilled obligations, quality breaches, misleading listings), or a pattern of complaints under the published seller-quality policy.
  12. Systematic failure to fulfil orders: undelivered paid files, prolonged unexplained delays.
  13. Harassment, threats, abuse, or other behaviour harmful to other users or Getly staff, as evidenced by messages, platform logs, or substantiated complaints.
  14. A binding request from law-enforcement, regulatory, or judicial authorities in the relevant jurisdiction, to the extent and in the manner expressly required by that request and by applicable law.
  15. Voluntary closure or suspension at the verified request of the account owner under paragraph 1 of this Section (this is not a sanction for breach).

We may act with or without prior notice, depending on the nature and severity of the breach, the risks to other users and the platform, and the requirements of applicable law. Immediate action applies in cases of fraud, prohibited content, AML/KYC risks, threats, and binding authority requests.

If you believe the decision was made in error, you may contact support at support@getly.store. We will consider the request in good faith within a reasonable time and inform you of the outcome. The final decision rests with Getly Store.

9.A Funds Held, Forfeiture, and Buyer Protection

Where a seller account is suspended or terminated, Getly Store may: (a) hold pending payouts for up to 180 days from the date of suspension to settle potential refunds, chargebacks, buyer claims, and payment-processor penalties; (b) on confirmation of the breach, forfeit (in whole or in part) the withheld funds and apply them toward refunds to affected buyers, compensation of the platform's costs, or other lawful use; (c) pause active subscriptions and issue pro-rata refunds to buyers; (d) decline payouts where the source of funds cannot be verified under AML/KYC. At the end of the hold period and absent substantiated claims, the balance is paid out to the seller net of withheld and forfeited amounts.

9.B Data Erasure and Retention on Closure

On the closure or termination of an account we give effect to your right to erasure to the extent permitted by law. Some data is retained on the basis of applicable law and our legitimate interests: accounting and tax records — for the periods required by the tax legislation of the relevant jurisdiction; KYC/AML data — for the periods required by anti-money-laundering legislation; a limited dataset to prevent repeat breaches (fraud logs, identifiers of banned accounts) — for a period not exceeding 3 years from termination.

9.C No Re-Registration

Persons whose accounts have been terminated for breach may not create new accounts on the platform — personally, through linked persons, or using other identifiers. Any such accounts are subject to immediate suspension, and pending payouts in them are subject to holding or forfeiture under Rule §14.

10. Limitation of Liability

Getly provides the platform "as is" without warranties of any kind, express or implied. We are not responsible for the quality, safety, or legality of products sold by third-party sellers. Our total liability is limited to the amount of fees collected from you in the 12 months preceding the claim.

11. Governing Law & Disputes

These terms are governed by applicable law. Any disputes that cannot be resolved through our built-in dispute system should be directed to support@getly.store for mediation.

You agree to attempt informal resolution before pursuing any legal action. Getly's moderation team will review disputes and make reasonable efforts to reach a fair resolution.

12. Affiliate Program

12.1 Overview

Getly offers an affiliate program that allows users to earn commissions by promoting products. Affiliates earn a percentage of each sale made through their unique referral links.

12.2 Eligibility

Any registered user may apply to become an affiliate. Applications are reviewed and may be auto-approved or manually reviewed depending on platform settings.

12.3 Commission Structure

Commission rates are set by individual sellers for their products. The affiliate commission is deducted from the seller's share (not the platform fee). Commissions are tracked for 30 days after the initial click.

12.4 Prohibited Practices

Affiliates may not:

  • Use misleading or deceptive advertising
  • Engage in cookie stuffing or forced clicks
  • Bid on Getly-branded keywords in paid advertising
  • Create fake accounts to generate commissions
  • Misrepresent their relationship with Getly

12.5 Payouts

Affiliate earnings are paid out on the same schedule as seller payouts (1st and 15th of each month). Minimum payout threshold applies. Getly reserves the right to reverse commissions from fraudulent or refunded transactions.

13. Referral Program

13.1 Overview

Getly provides a referral program where users earn rewards for inviting new users to the platform. Each user receives a unique referral code upon registration.

13.2 Rewards

Referral rewards are granted when a referred user completes their first purchase. Reward amounts and types are determined by Getly and may change at any time.

13.3 Limitations

Referral codes may only be used by genuine new users. Self-referrals, fake accounts, and manipulation of the referral system will result in forfeiture of rewards and potential account suspension.

13.4 Changes

Getly reserves the right to modify, suspend, or terminate the referral program at any time without prior notice.

14. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect.

15. Severability & Entire Agreement

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms of Service, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Getly regarding the use of the platform.
